Terms of Service
Last updated 8 October 2026
Upstay helps you explore accommodation listings and find potential upgrades to a booking you hold. It is a monitoring tool. It is not a booking service, a travel agency, or a party to anything you book.
1. What Upstay does
Upstay maintains a curated set of listings in the destinations it covers. Some destinations support scheduled availability and price checks; others offer catalogue browsing with dates, prices and cancellation terms to be confirmed on Airbnb. The interface identifies that difference. In a destination with monitoring, if you tell Upstay about a booking you hold, or about a search you care about, it compares what it finds against your preferences and shows potential matches. “Better” refers to the features compared, not a guarantee about your experience.
2. What Upstay does not do
- It never books, changes or cancels anything. Every reservation is made by you, directly with the accommodation platform, on that platform's own terms.
- It never takes accommodation payments. Those are made directly on the booking platform. It has no access to your account on any booking platform.
- It is not affiliated with, endorsed by, or connected to Airbnb, Inc. or any other accommodation platform. Listing names, prices and photographs belong to their owners and are shown for identification only.
3. Accounts
Browsing needs no account. Creating a watch does, because a watch is a standing instruction the service acts on repeatedly and it has to belong to someone.
You can create an account using an email address and a password. When email delivery is available, a single-use email code or link can also sign you in. Keep your password and mailbox secure. Email notifications require a verified email address; your findings remain available in Trips.
One account per person. You must be old enough to form a binding contract where you live, and at least 16.
4. Accuracy, and what it is reasonable to expect
This section matters more than most, so it is written plainly.
- Observations can be out of date. Availability and prices are read from public listing pages at intervals. A property can be booked, repriced or withdrawn between one check and the next.
- Listed rates are reference prices, not bookable quotes. Cards and search filters use the same listed nightly rate; an estimated rate is marked with ≈. Separately dated price observations may appear in a listing’s details. Fees, taxes and per-guest charges vary by platform and party size. Confirm the final total on Airbnb.
- Your booking’s deadline must come from your confirmation. A public listing’s current cancellation policy does not establish the terms of a reservation you already made. Upgrade alerts stop at the deadline you supply. Confirm the refund amount on the booking platform before cancelling.
- Always confirm on the booking platform before you act. What that platform shows at the moment of booking is the truth; Upstay is a pointer to it, not a substitute for it.
Upstay does not guarantee that any property shown is available, that any price is obtainable, or that a better option will ever be found for a given search.
5. Using the service reasonably
- Do not attempt to scrape, mirror or bulk-download the service, or use it through automated clients other than an ordinary web browser.
- Do not attempt to access another person's account, watches or findings.
- Do not use the service to break the terms of any accommodation platform.
- Do not attempt to disrupt or overload the service.
6. Availability of the service
Upstay is provided as-is and may be unavailable, interrupted or discontinued at any time. Data collection can stop for reasons inside or outside the operator's control, and gaps in monitoring are possible. No uptime is promised.
If paid Upstay plans are offered, their price, term and included features are shown before checkout. Stripe processes payment for those Upstay services; Upstay does not store full payment-card numbers or security codes. An Upstay plan never purchases an accommodation reservation. Subscription management, when applicable, is available through your account.
7. Your content
What you enter — the dates you care about, what you paid, the criteria you set — remains yours. You grant only the permission needed to operate the service for you: storing it, and using it to run the comparisons you asked for. It is not sold, shared or used to build a profile of you.
8. Ending things
You may stop using Upstay at any time and ask for your account and data to be deleted; see the Privacy Policy. The operator may suspend or end an account that breaches these terms, or discontinue the service, with notice where reasonable.
9. Liability
To the maximum extent the law allows, Upstay and its operator are not liable for losses arising from booking decisions you make, from information that was out of date or inaccurate, or from the service being unavailable. You are responsible for the bookings you make and for reading the cancellation terms of the platform you book through.
Nothing here excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.
10. Changes
These terms may change as the service does. Material changes will be noted here with a new date at the top. We may also notify affected account holders by email. Continuing to use the service after a change means accepting it.
11. Contact
Upstay operates this service. Contact support@upstay.app for support or questions about these terms. Nothing in these terms limits mandatory consumer rights that apply where you live.
12. Attribution
Curation and neighbourhood data come from Inside Airbnb, used under CC BY 4.0. Map tiles are © OpenStreetMap contributors. Availability and prices are observed independently from public listing pages.
